Terms of Service
Effective 21 August 2026 · Updated 13 October 2026 · Dayboard Pty Ltd · ABN 44 701 498 044
The short version
- Month to month, billed in arrears, cancel anytime in the app: no lock-in, no phone call.
- Your data is yours. You can export all of it, any day, and when you leave it is deleted on a published timetable.
- You pay per active user at the published prices. Price changes get 30 days' notice, and you can leave before they apply.
- You're responsible for what your company puts into Dayboard; we're responsible for running the service properly and keeping your data safe and private.
- Nothing in these terms takes away rights the Australian Consumer Law says you keep.
These are the full terms. They are deliberately short and written to be read. If anything is unclear, ask us before you agree to it: privacy@dayboard.com.au.
1. The agreement
These terms are an agreement between Dayboard Pty Ltd (ABN 44 701 498 044) ("Dayboard", "we", "us") and the company or business that signs up ("you", "your company"). By creating an account you agree to them on your company's behalf, and you confirm you have the authority to do that. Everyone your company adds as a user uses Dayboard under your company's agreement. When an account is created we record the date and the version of these terms that was accepted.
Our Privacy Policy explains how we handle personal information and forms part of this agreement.
2. The service
Dayboard is scheduling software for field crews: jobs, quotes, people, plant and vehicles, documents, site forms and prestarts, servicing records, and notifications, in a web app that works on any modern phone or computer browser. We will provide the service with due care and skill, as the Australian Consumer Law requires of us anyway.
Quotes are a record-keeping tool. The prices, the GST treatment and the terms your company offers its clients are your company's own, and Dayboard does not check them or give tax, legal or commercial advice about them. The same is true of a job's value, its variations and the invoices your company records against it: Dayboard keeps the record, and does not make invoices, take payments or give accounting advice.
3. Your account and your users
- Keep your sign-in details secure and your account information accurate. Tell us promptly if you believe an account has been compromised.
- Your company's administrators control who has access and at what level. You are responsible for the actions people take in your account with access your company gave them.
- Each user account is for one person: shared logins defeat the audit trail that features like acknowledgements exist to provide.
4. The free trial
New accounts get a 14-day free trial with full features and no card required. If you do not subscribe by the end of it, your account becomes read-only (you can still sign in, export everything, and subscribe), and if it stays lapsed, the account and its data are permanently deleted 90 days after the trial ends.
5. Fees and billing
- Pricing is per user per month, by role, at the prices published at dayboard.com.au/#pricing. Published prices include GST.
- You are billed monthly in arrears for the users active during that month. A person you have invited who has not yet activated their account costs nothing; deactivating a user stops them being billable.
- Paid billing starts from the first day of the month after you add a payment method, so you are never charged a full month for a few days.
- Card payments are processed by Stripe; we never hold your card number. We issue a tax invoice for every charge.
- Price changes get at least 30 days' notice by email to your administrators, and take effect from a following month's invoice, so you can always cancel before a new price ever applies to you. A founding-customer discount is honoured for the life of the subscription on the terms it was offered. A founding slot is claimed when a company first adds a payment method, not when it starts a trial.
- If a payment fails we will retry and tell you. While an account has unpaid fees it becomes read-only, but it is never deleted for non-payment: your data waits, exportable, until you settle up or cancel.
6. Cancelling, and what happens to your data
- You can cancel anytime, in the app, effective from the end of the current billing month. You pay for the month you used and nothing after.
- From cancellation your account is read-only so you can take your time exporting. 60 days after cancellation the account and all its data are permanently deleted (uploaded files first, then database records) on the timetable published in the Privacy Policy.
- The export is always available to your administrators, before and after cancelling: every record as spreadsheets and every document in a folder tree. It is the product's exit promise and it is part of this agreement, not a courtesy.
7. Your data stays yours
Everything your company puts into Dayboard (jobs, records, documents, photos, filled-in forms) remains your company's. You grant us only the licence we need to host, process, back up, and display it to provide the service to you, and for nothing else. We do not mine it, sell it, or use it to train AI models, as the Privacy Policy also promises.
8. Your responsibilities for what you put in
- You are responsible for having the right to store what you upload, including having a proper basis for the personal information you enter about your crew and contacts, and making those people aware of our Privacy Policy.
- Do not enter sensitive information (such as health information) beyond what your own legal obligations genuinely require and the person concerned is aware of.
- Dayboard is a record-keeping tool, not compliance advice. Features like the acknowledgement trail help you keep good records, but we do not warrant that any record satisfies a particular work health and safety or other regulatory obligation. What your obligations are, and whether you have met them, remains your company's responsibility.
9. Acceptable use
Use Dayboard lawfully and as intended. Do not:
- upload material that is illegal or that infringes someone else's rights;
- upload malware or attempt to breach or probe the service's security, including attempting to access another company's data;
- resell the service or misrepresent who operates it;
- place deliberately excessive load on the service. We may apply reasonable technical limits (such as file-size caps) to keep the service healthy for everyone.
10. Availability and support
We work to keep Dayboard available around the clock and we back up nightly, but no online service can honestly promise zero downtime, and we do not. Planned maintenance is done at low-traffic times where practicable. Support is by email, and we answer.
11. Our intellectual property
The Dayboard software, name, and design are ours. If you send us feedback or suggestions we can use them to improve the product without owing a fee. That is feedback's normal fate, stated plainly.
12. Liability
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or any other law that cannot be excluded. Where the law lets liability for breach of a non-excludable guarantee be limited, our liability is limited, at our choice, to resupplying the service or paying the cost of having it resupplied.
Otherwise, and to the extent the law permits:
- neither of us is liable to the other for indirect or consequential loss (such as loss of profits or business opportunity); and
- our total liability arising out of the service in any 12-month period is limited to the fees your company paid us in that period.
Nothing limits either party's liability for fraud, or excludes anything the law does not allow to be excluded.
13. Suspension and termination by us
- We may suspend or terminate an account for a material breach of these terms. Except where the breach threatens the security of the service, another customer, or a person (where we may act immediately), we will tell you what the problem is and give you at least 7 days to fix it first.
- Termination for breach does not shorten your data rights: the export remains available and the deletion timetable in section 6 still applies.
- If we ever discontinue Dayboard entirely, we will give at least 60 days' notice so you can export and move.
14. Changes to the service and these terms
We improve the service continually; improvements do not require notice. If we change these terms in a way that meaningfully reduces your rights or increases your obligations, we will email your administrators at least 30 days before the change takes effect, and since you can cancel anytime, no change can ever be forced on you. The current terms are always at this address, with their effective date above.
15. General
- Governing law: these terms are governed by the laws of Tasmania, Australia, and both parties submit to the courts of Tasmania and the federal courts of Australia.
- If Dayboard Pty Ltd is sold or merged, this agreement may be assigned to the new owner on the terms described in the Privacy Policy; you may not assign it without our consent, which we will not withhold unreasonably (for example, if your business changes hands).
- If part of these terms is found invalid, the rest still stands.
- Not enforcing a term once is not a waiver of it.
- Formal notices go by email: ours to your administrators' addresses, yours to the address below.
- These terms and the Privacy Policy are the whole agreement between us about the service.
